Home Sellers filed suit against the National Association of Realtors (NAR) and several major brokerages stating they felt the "real estate industry" conspired to inflate agent commissions.

Recent Court Rulings Effect Brokerages & Buyer's Agents

This will most likely result in:

  • Buyer Side Commissions being eliminated from Seller Listing Agreements & MLS, and

  • Being negotiated by a Buyer's Agent Client with their Client, OR

  • During Contract Negotiation, the Seller MAY knowingly understand and agree to pay a Buyer's Agent (This is will be at the Seller's Discretion.)

What are Your options as a Buyer?

Go it Alone

  • Find a home on your own (Zillow.com, Homes.com, Realtor.com, etc.)

  • Negotiate with the Seller and their Agent (if they have one)

  • Prepare your own Contract Documents, or Allow the Seller's Agent to prepare all documents

  • Schedule your own Appraisal and Inspections

  • Submit through a Title Company to Close.

"Dual Agency"

  • Find a home on your own

  • Negotiate with the Seller and their Agent to enter into a "Dual Agency" Agreement where the Agent will represent both of you (without Bias), in some States this is referred to as a "Transcation Agent". In some states "Dual Agency" is not allowed.

Find a Buyer's Agent

  • Negotiate with the Agent to determine what services they will provide you.

  • Negotiate with the Agent to determine how and what compensation the Agent will recieve for those services.

  • Negotiate when the services will be paid for. (Up-front or at Closing)

  • Proceed with finding, contracting, and closing on a home.
